1. Agreement to Terms

By accessing or using the services provided by MobileAppsFast ("Company," "we," "our," or "us"), including our website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

MobileAppsFast provides mobile application development services, including but not limited to custom app development, cross-platform development, app maintenance, and related consulting services. The specific services provided will be outlined in separate agreements or statements of work.

3. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts

Some features of our Services may require you to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload or transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity or performance of our Services
  • Attempt to gain unauthorized access to our systems or networks
  • Engage in any activity that is fraudulent, deceptive, or misleading
  • Collect or harvest user information without consent
  • Use our Services to develop competing products or services

6. Intellectual Property Rights

Our Intellectual Property

The Services, including all content, features, and functionality, are owned by MobileAppsFast and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

Your Content

You retain ownership of any content you submit through our Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of providing our Services to you.

Client Work Product

Unless otherwise specified in a separate agreement, upon full payment for development services, clients receive ownership of the custom application code developed specifically for them. We retain ownership of any pre-existing code, frameworks, libraries, or tools used in development.

7. Payment Terms

For paid Services:

  • Payment terms will be specified in your service agreement or invoice
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to modify pricing with reasonable notice
  • Late payments may result in service suspension or termination

8. Third-Party Services

Our Services may integrate with or contain links to third-party services, including but not limited to app stores (Apple App Store, Google Play Store), payment processors, and analytics providers. Your use of such third-party services is subject to their respective terms and policies. We are not responsible for the content or practices of third-party services.

9. App Store Compliance

If you use our Services to develop mobile applications distributed through app stores:

  • You are responsible for ensuring your app complies with all applicable app store guidelines and policies
  • You acknowledge that app store operators (such as Apple and Google) are third-party beneficiaries of these Terms
  • We will provide reasonable assistance to help meet app store requirements, but ultimate compliance responsibility rests with you

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • The results obtained from the Services will be accurate or reliable
  • Any errors in the Services will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILEAPPSFAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Services
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Services
  • Any bugs, viruses, or other harmful code that may be transmitted through the Services

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless MobileAppsFast and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Services will immediately cease
  • We may delete your account and any associated data
  • All provisions of these Terms that should survive termination shall survive

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and MobileAppsFast regarding the Services and supersede all prior agreements and understandings.
